You (as used herein “you”, “You”, or “your” shall refer to the featured artist) have offered to make your designs available to be sold through Interior Ink on the website (the “Site”) as fabric, wall coverings, shades, and/or other products available for custom print (the “Featured Artist Program”). Participation in the Featured Artist Program is optional and available to anyone who agrees to the terms of this Agreement. This agreement (the “Agreement”) will explain the terms that regard the availability of your designs within the structure of the Featured Artist Program. This Agreement is in addition to any obligations made under the Interior Ink’s Terms of Service (the “Terms”) which is included herein by reference. Any defined term in the Agreement that is not otherwise defined here shall have the meaning ascribed to it in the Terms.
By providing Interior Ink with designs to be used in the Featured Artist Program, you are indicating that you consent to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you will not be allowed to participate in the Featured Artist Program nor have a featured artist page on the Site.
Interior Ink reserves the right to modify or add to this Agreement at its discretion. Interior Ink will notify you of major changes made, but it is your responsibility to be sure you agree to the terms of the current Agreement. It is your responsibility to contact Interior Ink if you do not agree with a modification or amendment to this Agreement. No response from you shall signify your acceptance and consent to be bound by the amended Agreement. If you don’t agree to the Amended Agreement, or if you ever have any questions about this Agreement, contact us at email@example.com.
Participation in the Featured Artist Program is optional and open to all artists who opt-in and agree to the terms of this Agreement. After you have been accepted into the Featured Artist Program and have agreed to the terms of this Agreement, you may send or transfer your artwork or designs (the “Content”) to Interior Ink. To add Content to be made available for purchase on the Site, Interior Ink requires you to send or transfer both the original digital copies of designs that meet minimum standards, as defined by Interior Ink below or in any communications sent, and send or transfer smaller thumbnail images of the designs with a max resolution of 72dpi.
You will be required to include a photograph of yourself and a short autobiography. Interior Ink can send you a list of questions to be answered in the autobiography if needed. For each design, you will be required to include a name, description, and tags for the design in order to help the customers find the design. All patterns must be seamless and sent in vector format. With your approval, Interior Ink requests the right to edit colors in any design, if needed. This is to uphold Interior Ink’s standard of offering a customized and unlimited color palette to its customers. Interior Ink can provide examples of such a case upon request. If you provide designs with multiple color variants, the Interior Ink may not need to edit any colors.
In order to improve printing quality, Interior Ink, may at its discretion adjust or modify your Content to achieve optimal results. Such modifications may include but are not limited to, cropping, tiling, image filters, etc. Interior Ink will not change any design that is in any way not authorized by the artist nor stated in this Agreement.
As with any other Content, you represent that you own or otherwise are authorized to use the design you are submitting. You further agree that the use or sale of the design will not violate the copyright, trademark, or other proprietary rights of any third-party. Further, you will not use any third-party trademarks, trade names, or publicity rights in connection with the name, description, or tags associated with your design that may result in confusion as to the source of the design. Interior Ink reserves the right to block, delete, modify, or edit any design, term or terms used to promote a design respectively if it believes, in its exclusive discretion that the use may violate a third-party right or is otherwise objectionable.
By opting into this Featured Artist Program, you also agree to provide your accurate and up-to-date address and contact information. You may be asked from time-to-time to provide current information or verify that information you have previously provided is correct. Failure to timely provide accurate and up-to-date information will result in the temporary suspension of your Featured Artist page on the Site. Once information is updated or verified, your suspension will be lifted, and your page will be made available again.
It is at your discretion to order a custom sample of your designs to verify the colors, design, and other aspects have been reproduced correctly. Should you choose to participate in this action, you are responsible for the costs associated with ordering and receiving the sample(s) at the current market price, and will not receive a commission, or royalty for your order of a sample.
By opting to participate in the Featured Artist Program, you agree that:
Royalties will be paid out once per period. Any bonuses will be calculated at the end of the month based on the total monthly sales and if earned, will be included in the payment for the following period.
According to Georgia and United States law, it is required that Royalties earned must be declared as income. Please consult your tax advisor or the IRS website for more information on how to declare your Royalties earnings.
Interior Ink requires its Featured Artists to provide certain tax information. You agree to provide accurate tax information upon request by Interior Ink, such information shall include but is not necessarily limited to, your complete and correct name (the business name for legal entities), and tax ID, Social Security number or Tax Identification number (as applicable).

Failure to provide complete and accurate tax information will result in default of this Agreement. Your page in relation to the Featured Artist Program will not be made live and your participation in this program will be forfeited. If any Royalties have been made prior to termination, Interior Ink may charge a termination fee, as referenced in the previous section.
By January 31st the following year, Interior Ink will send out 1099-misc forms for all Artists that receive $500 or more in Royalties in the previous year. We require you to submit the correct form prior to the activation of your Featured Artist page on the Site.
You agree to defend, indemnify and hold Interior Ink and Interior Ink’s officers, directors, employees, and other Representatives harmless from all judgments, awards, losses, liabilities, costs, expenses, including but not limited to reasonable attorney’s fees, expert witness fees, and costs of litigation arising out of or based on: (a) a third-party claim that any design offered for sale through the Featured Artist Program or the Content associated with the design, violate intellectual property right of the third-party; (b) Any of your designs available to be sold through the Site; (c) your failure to pay your tax obligations from your Royalties on a sale; or (d) your violation of this Agreement.
THE FEATURED ARTIST PROGRAM, THE SITE AND THE INFORMATION, SERVICES, PRODUCTS, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, INTERIOR INK AND ITS REPRESENTATIVES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF TITLE, OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM INTERIOR INK OR FROM THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
INTERIOR INK DOES NOT MAKE ANY WARRANTY THAT (A) CONTENT OR ANY PRODUCTS ORDERED THROUGH THE SITE WILL MEET YOUR REQUIREMENTS, OR (B) THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (C) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR SOLD BY YOU THROUGH THE FEATURED ARTIST PROGRAM OR THE SITE WILL MEET YOUR EXPECTATIONS.
All other terms applicable to the Featured Artist Program or any other features of the Site are included in the Terms of Service.
At the discretion of Interior Ink, Interior Ink reserves the right to deny any person(s) a spot in the Featured Artist section on the Site. Additionally, we reserve the right to remove or deny any design currently or otherwise intended to be used on the Site.
Interior Ink reserves the right to limit the number of designs you include on your Featured Artist page at a time.
You are encouraged to keep up to date with the trends of the industry in order to provide Interior Ink with designs that are more likely to sell.
Especially if you have a website or social media page dedicated to your artwork or your designs, it is requested that you advertise the availability of your designs to be printed on products offered by Interior Ink. Interior Ink will provide you with a URL that will link directly to your Featured Artist page on the Site for you to use in your own advertisements.
